At CPLS, P.A., we handle a full spectrum of divorce cases ranging from simple to complex, and from amicable to contested. Whether you and your spouse are willing to work together to quickly negotiate an agreement or you have come to an impasse over a disputed matter, we are prepared to assist you.
Florida is a no-fault state, which means there is no consent needed by either spouse to get
divorced. However there are two requirements under Florida law that must be met in order to
file for divorce: the parties must have six (6) months of residence in the State of Florida
prior to filing for divorce and a statement by either spouse under oath stating that the
marriage is irretrievably broken.
Many divorces involve other issues including time sharing, child support, alimony, equitable
distribution, and attorney's fees. At CPLS, P.A., our goal is to
resolve your case amicably with as little loss of money and assets, while still retaining
your dignity and sanity.
Collaborative Divorce vs. Traditional Divorce
It is important to hire a divorce attorney who is familiar with the various choices available to people seeking divorce. Attorney Anthony Diaz has experience helping clients understand their options and providing effective advocacy through both alternative dispute resolution methods, including collaborative divorce, and traditional litigation.
Traditionally, divorce is handled through litigation. A husband and wife may each hire an attorney or choose to represent themselves. Traditional divorce litigation can often be a lengthy and expensive process that may not give the husband and wife the resolution they desire. Collaborative law is a popular alternative to conventional divorce because it allows both parties to have a say in the final outcome, rather than letting a judge make a final determination.
We will carefully examine all components of your divorce, including child custody/time sharing, property division, alimony and child support, in order to achieve a fair settlement that meets your needs and goals.
We also represent clients in post-judgment modifications following a substantial change in circumstances. Contact us to learn more about modifying any aspect of your divorce agreement.
Divorce Lawyer Handling Property Division in Orange County, Florida
Property division can be one of the most complex areas of divorce. All assets or debts accumulated during the marriage must be equally divided. However, there are many nuances that can come into play while dividing property during divorce, which depend on each unique case.
Equitable Distribution
Distribution of the martial assets can be resolved within the parties by agreement, at mediation, or at trial at the discretion of the Judge. In distributing the assets a Judge will considered, among other factors, each spouses contribution to the marriage, the duration of the marriage, the economic status of each spouse, and the overall enhancement of the marriage during the pendency of the marriage, both marital and non-martial.
Due to his background as a CPA and an attorney, Anthony Diaz offers his clients valuable insight and knowledge as he represents their interests during property division negotiations
